RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, INDEMNITY AND HOLD HARMLESS AGREEMENT

I, hereby acknowledge that I am over the age of 18 and have voluntarily elected to participate in foraging for plants, florae and/or naturally occurring organic materials (collectively hereafter referred to as, “Plants”), the harvesting of Plants, consumption of Plants, identification of Plants and searching for Plants (“Activity”). In consideration for being permitted to participate in the Activity, I hereby acknowledge and agree to the following:

ELECTIVE PARTICIPATION: I acknowledge that my participation is elective, and that the Activity is unsupervised.

RULES AND REQUIREMENTS: I agree to conduct myself in accordance with Federal and State of Arizona rules, regulations, statutes, and/or standards of care. I grant LEGACY WILDERNESS ACADEMY LLC dba LEGACY WILDERNESS ACADEMY (“Legacy”) the right to terminate my participation in the Activity if it is determined that my conduct is detrimental to the best interests of Legacy or violates any rules, regulations, statutes, and/or standards of care.

INFORMED CONSENT: I have been informed of and I understand the various aspects of the Activity and have been given an opportunity to investigate the Activity. I appreciate that the Activity includes dangers and risks, and Legacy cannot know of all potential risks to me. I understand and agree that Legacy cannot control the risks associated with the Activity and/or any related undertakings, including but limited to misidentification of Plants, dangerous compounds that could be present on Plants and latent effects of consuming hazardous substances (i.e., cancer or other disease). I understand that as a Participant in and/or even just as an observer of the Activity or any aspect of the Activity, I can sustain serious personal injuries, illness, property damage, or even death as a consequence of not only Legacy’s actions, inactions, or negligence, but also the actions, inactions, or negligence of others, conditions of equipment used, and that there may be other risks not known to me or not reasonably foreseeable at this time. I further understand and agree that any injury, illness, property damage, disability, or death that I may sustain by any means is my sole responsibility. I agree that the material on Legacy’s website or presented by Legacy is presented for general informational and educational purposes only, and under no circumstances is to be considered a substitute for identification of an actual biological specimen by a person qualified to make that judgment.

RELEASE AND WAIVER OF LIABILITY: I, on behalf of myself, my personal representatives, heirs, executors, administrators, agents, spouse, children, family members, and assigns, HEREBY RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE Legacy and its respective directors, officers, employees, contractors, consultants, and agents (hereinafter referred to as “Releasees”) for any and all liability, including any and all claims, demands, causes of action (known or unknown), suits, or judgments of any and every kind (including attorneys’ fees), arising from any injury, property damage, or death that I may suffer as a result of my participation in the Activity, REGARDLESS OF WHETHER THE INJURY, DAMAGE OR DEATH IS CAUSED BY THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE. I further agree that all the terms of this Agreement shall extend to and protect the

owner and/or lessee of any real property, public or private, that is used to host an Legacy event or activity.

ACKNOWLEDGEMENT OF UNKNOWN FACTS: I acknowledge awareness that I may hereafter discover facts different from or in addition to those known or suspected to exist at the time of executing this Agreement, it is nevertheless my intention hereby to release any and all such claims. In the furtherance of such intention, the release given herein shall be free and remain in effect, notwithstanding the discovery of any such different or additional facts. I acknowledge and agree that I may hereafter discover facts different from or in addition to those now known, suspected, or believed to be true and agree that this release will be and remain effective in all respects notwithstanding any such differences or additional facts. It is expressly understood and agreed that the possibility of such claims existing has been explicitly taken into account in determining the consideration, having been bargained for in full knowledge of the possibility of such unknown claims and was given in exchange for the release and discharge of claims covered by this Agreement.

INDEMNIFCATION: I, on behalf of myself, my representatives, heirs, executors, administrators, agents, and assigns, agree to hold harmless, defend, and indemnify the Releasees from any and all liability, including any and all claims, demand, causes of action (known or unknown), suits, or judgments of any and every kind (including attorneys’ fees), arising from any injury, property damage, or death that I may suffer as a result of my participation in the Activity, REGARDLESS OF WHETHER THE INJURY, DAMAGE, OR DEATH IS CAUSE BY THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE.

CHOICE OF LAW/SEVERABILITY: I hereby agree that this Agreement shall be construed in accordance with he laws of the State of Arizona and that this Agreement is intended to be as broad and inclusive as permitted by such law. I further agree that if any portion hereof is held invalid, the balance shall, notwithstanding, continue in full force and effect.

I HAVE READ THIS AGREEMENT AND FULLY UNDERSTAND ITS TERMS. I AM AWARE THAT THIS AGREEMENT INCLUDES A RELEASE AND WAIVER OF LIABILITY, AN ASSUMPTION OF RISK, AND AN AGREEMENT TO INDEMNIFY THE RELEASEES. I UNDERSTAND I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY ENTERING THIS AGREEMEN AND ENTER IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
